(NECN) - An American father won another round in his legal battle to regain custody of his son, who has lived in Brazil since his mother took him there in 2004 on a two-week vacation that never ended.
David Goldman's 9-year-old son, Sean, was to be handed over to him at the U.S. Consulate in Rio de Janeiro on Friday -- a move his own attorney warned could be blocked by additional appeals.
Goldman was flying from the United States -- he resides in Tinton Falls, New Jersey -- to Rio after learning the case was ruled in his favor.
"I'm hopeful," Goldman said before boarding his flight. "My focus is to go down there and bring my son back to me and his family safe."
There remains the chance that the full reunion with his son could be delayed, due to potential appeals by the boy's maternal grandmother and stepfather.
Still, Goldman hoped for a smoother experience upon greeting his son.
"I love you, let's go home," Goldman said would be his first words to his son. "I hope it can be that simple."
This case began in 2004 when Goldman's wife, Bruna Bianchi, traveled with her son on what was supposed to be a two-week vacation. The pair never returned stateside, and Bianchi eventually obtained a Brazilian divorce from Goldman and remarried.

"As ... we were coming home, he said, 'Where's our home?' Just to hear him say 'our home,' " Goldman said at a Tuesday afternoon press conference, his voice cracking with emotion. "I waited five years to hear him say that."
Sean, 9, was returned to David just days ago after a lengthy and contentious international legal battle with his deceased ex-wife's family that went as high as Secretary of State Hillary Clinton.
And those first days back? Just a typical holiday with a dad and a son – in other words, pure magic.
"He's happy. He just wants to have fun," Goldman, of Tinton Falls, N.J., said, noting that they played video games, had hot chocolate, played with Sean's cousins, and opened Christmas presents.
"He got inside, and he saw the Christmas tree. And he saw the presents, and he started ripping them open," he said. "And he saw the little kitty cat, and went right over to her and started petting her."
And after a few nights sleeping "like a baby – except he didn't wet the bed and cry" – Sean was already up for a new adventure.
"He wanted to go fishing today," Goldman said, laughing proudly. "It's 20 degrees out, and he wanted to go fishing."

RÍO DE JANEIRO, Brasil, dic. 24, 2009.- El niño Sean Goldman, reclamado en los tribunales por su padre, un estadounidense, desde el año 2004, cuando la madre, brasileña, se lo llevó a Brasil de vacaciones y nunca regresó a EU, viajó este jueves a Nueva York en compañía de su progenitor.
David Goldman y su hijo Sean embarcaron hacia las 11:45 hora local (13.45 GMT) en un avión fletado por el gobierno de Estados Unidos con rumbo a Nueva York luego de que la familia brasileña devolviera al menor en el consulado de Estados Unidos en Río de Janeiro.
Los abuelos maternos y el padrastro del menor, que disputaban la custodia con el padre, entregaron al niño de 9 años en cumplimiento de una sentencia en última instancia del Supremo Tribunal Federal (STF), la máxima corte de Brasil y hasta donde llegó el litigio.
La custodia de Sean Goldman transitaba en los tribunales desde 2004, cuando su madre, Bruna Bianchi, lo trajo a Brasil supuestamente de vacaciones pero nunca regresó a Nueva York, en donde vivían.
Bianchi, que volvió a casarse en Brasil, falleció en 2008 durante el parto de su segunda hija.
