Sai acórdão sobre ‘caso Battisti’. Com a palavra, Lula



A edição eletrônica do Diário de Justiça traz, nesta sexta (16), o acórdão com o resumo da decisão do STF sobre o pedido de extradição de Cesare Battisti.

Lula dissera que só decidiria o destino do ex-terrotista italiano depois da veiculação do acórdão. Pois bem, não precisa esperar mais.

A Itália reivindica a extradição de Battisti, condenado por quatro homicídios ocorridos na década de 70.

O Supremo autorizou a extradição. Decidiu que a palavra final é do presidente. Depois, fez um adendo.

Ficou entendido que Lula precisa observar um Tratado de Extradição que o Brasil assinou com a Itália. Foi referendado pelo Congresso. Tem peso de lei.

O tratado faculta ao presidente a prerrogativa de negar a extradição. Mas Lula terá de alegar que, devolvido à Itália, Battisti seria vítima de perseguido político.

Coisa difícil de sustentar, já que o STF derrubou o ato que concedera status de refugiado político a Battisti, assinado pelo então ministro Tarso Genro (Justiça).

Na hipótese de optar por reter Battisti no Brasil, Lula comprará uma briga com o governo da Itália. E a encrenca pode voltar ao STF.

Pedreiro preso por assassinato de jovens em GO é encontrado morto

O pedreiro Adimar da Silva, preso em Goiás pelo assassinato de seis jovens em Luziânia (GO), foi encontrado morto na cela na manhã deste domingo (18). Ele estava preso em uma cela isolada no Denarc de Goiânia.

Ele estava preso desde o dia 10 de abril, quando confessou ter matado seis jovens que estavam desaparecidos desde dezembro de 2009. O pedreiro ainda indicou à polícia onde os corpos das vítimas estavam escondidos.

Silva já cumpria pena de dez anos e dez meses por atentado violento ao pudor. Ele passou quatro anos em regime fechado e, em dezembro, passou para o regime semiaberto, mesmo mês em que os desaparecimentos tiveram início.

Segundo Norton Luiz Ferreira, delegado chefe de comunicação da Polícia Civil de Goiás, Adimar foi encontrado enforcado com uma tira do forro do colchão da cela por volta das 12h30. De acordo com a polícia, ele teria cometido suicídio.

Na manhã deste domingo ele teria conversado normalmente com os onze presos da cela ao lado, segundo a polícia. "Durante a conversa ele repetiu o depoimento que deu aos delegados e contou como matou os meninos", disse Ferreira.

Segundo a polícia, os vizinhos de cela teriam ouvido um barulho de rasgo de tecidos na tarde deste sábado.

Liberdade questionada

O benefício da liberdade provisória concedido ao pedreiro foi questionado após a descoberta das mortes em Luziânia. Documentos anexados ao processo que devolveu Silva às ruas revelam que a Justiça tinha laudos psicológicos que identificaram “sinais de sadismo” e “de transtornos psicopatológicos” em um exame criminológico realizado um ano e sete meses antes da sua libertação.

A Justiça também foi alertada pelo Ministério Público do Distrito Federal e Territórios (MPDFT) a implementar “fiscalização sistemática” sobre Adimar no dia 14 de janeiro deste ano, quando três dos seis jovens já haviam desaparecido.

No pedido, a promotora Maria José Miranda Pereira sustentou que a vigilância constante da Justiça sobre Adimar poderia “salvar a dignidade sexual de muitas crianças”. A promotora ainda utilizou um argumento direto para justificar sua preocupação sobre a conduta do pedreiro: “Não existe ex-estuprador. Considerando-se que não existe ex-estuprador e, diante da extrema gravidade dos ignóbeis crimes pelo sentenciado cometidos, requeiro seja expedido mandados para fiscalização sistemática e reiterada”, solicitou Maria José.

O pedido da promotora foi escrito de próprio punho atrás de um dos “Mandados de Constatação na Residência” ordenados pela Justiça em 7 de janeiro deste ano, para que um oficial fosse até a residência de Adimar para constatar se ele cumpria as determinações judiciais “de recolher-se à sua residência diariamente, até 21h, e nos dias de folga e feriados”.

Biography
