PGR se manifesta pelo recebimento da denúncia contra Paulo Maluf

De acordo com Roberto Gurgel, integrantes da família Maluf uniram-se em torno do objetivo comum de dissimular a origem de valores provenientes de crimes contra a Administração Pública praticados por Paulo Maluf
Durante julgamento do Inquérito 2471 pelo Supremo Tribunal Federal, o procurador-geral da República, Roberto Gurgel, se manifestou pelo recebimento da denúncia contra Paulo Maluf, familiares e outros por crimes contra o sistema financeiro nacional.

Roberto Gurgel destacou as três fases percorridas no processo de lavagem de dinheiro, de acordo com o conceito utilizado pelo Grupo de Ação financeira Internacional (Gafi). A primeira foi a fase de captação ou ocultação mediante o recebimento de recursos provenientes principalmente da construção da avenida Água Espraiada, concluída em 2000, com custo final de R$ 796 milhões.

A segunda, relatou o procurador-geral, é a fase de dissimulação ou estratificação, quando valores ilícitos foram entregues a um doleiro, que realizou remessas para uma conta localizada no Safra National Bank, de Nova Iorque. Dos Estados Unidos, foram remetidos valores para contas bancárias em sete fundos de investimento na ilha de Jersey, os quais também receberam recursos provenientes da Suíça e da Inglaterra.

A integração caracteriza a terceira fase, em que os fundos de investimento constituídos na ilha de Jersey utilizaram os recursos recebidos dos Estados Unidos para adquirir debêntures e ações da empresa Eucatex, da família de Paulo Maluf, de modo que os valores lavados foram reintegrados no Brasil, concluindo o ciclo criminoso.

Roberto Gurgel também afirmou que os crimes antecedentes, por meio dos quais foram obtidos os valores objeto da lavagem, foram apurados em inquérito policial e expressamente descritos em capítulo específico da denúncia e consistiram em corrupção passiva, formação de quadrilha e evasão de divisas, sendo objeto de denúncia apresentada pelo MPF nos autos de processo que se encontra atualmente no STF autuado como ação penal 477.

Validade da denúncia - Em sua manifestação, Roberto Gurgel rebateu uma série de argumentos apresentados pela defesa. É o caso, por exemplo, da alegação de que a denúncia teria usurpado atribuição do procurador-geral da República e afrontado competência do Supremo Tribunal Federal.

“Quando a denúncia foi oferecida, o procurador da República tinha atribuição para oferecê-la, já que o denunciado Paulo Maluf não gozava, naquele momento, de prerrogativa de foro. A autoridade judiciária que recebeu a denúncia tinha também competência pelo mesmo motivo. Não parece relevante a circunstância de, algum tempo depois, em razão da eleição do parlamentar, ter se deslocado a competência para o STF”, explicou.

Para Roberto Gurgel, também não procede a alegação de que a Lei n° 9613/98, por definir crime instantâneo, não teria aplicação aos fatos objeto da acusação, que teriam ocorrido antes de sua entrada em vigor: “Na verdade, os acusados foram denunciados por fatos que ocorreram entre 1993 e 2002. Sabemos que a lavagem de dinheiro é definida como crime permanente, cuja consumação prolonga-se no tempo enquanto os bens, valores e direitos estiveram dissimulados e ocultos”.

Quanto ao crime de quadrilha atribuído aos acusados, Roberto Gurgel ressaltou que “por óbvio, a denúncia jamais afirmou que a família Maluf foi constituída para o fim de praticar crimes. O que se disse, e está fartamente provado nos autos, é que integrantes da família Maluf uniram-se em torno do objetivo comum de ocultar e dissimular a origem de valores provenientes de crimes contra a Administração Pública praticados por Paulo Maluf, quando exerceu o mandato de prefeito de São Paulo”.

O procurador-geral também descartou o argumento de impossibilidade de imputação do crime previsto no artigo 1º, V, da Lei 9613/98. Para ele, a norma citada dispõe expressamente que o processo e julgamento pelo crime de lavagem de dinheiro independem do processo e julgamento dos crimes antecedentes, referidos no artigo 1º.

Outras alegações da defesa abordadas pelo procurador-geral foram a de validade da prova que sustenta a acusação e de inépcia da denúncia. De acordo com Gurgel, as provas foram obtidas por meio de inquérito policial que tramitou em São Paulo e as provas referentes à movimentação bancária dos acusados no exterior foram obtidas por meio de cooperação jurídica internacional com expressa autorização da autoridade judiciária brasileira e com estrita observância do ordenamento jurídico dos países em que se encontravam os documentos.

Roberto Gurgel acrescentou que a denúncia reúne os pressupostos necessários à sua admissibilidade. “Se os fatos ocorreram exatamente como descrito na denúncia e se os acusados foram efetivamente seus autores, é questão que não pode ser apreciada nesse momento”, concluiu.

Washington condemns assault on envoy in Syria; Clinton says the attack ‘unjustified’

The Obama administration blamed the Syrian government for an attack on the top U.S. envoy to Syria, saying it was part of an ongoing, orchestrated campaign to intimidate American diplomats in the country.

Secretary of State Hillary Rodham Clinton condemned the attack as “wholly unjustified.”

Clinton demanded that the Syrian government fulfill its international obligations to protect all foreign diplomats and diplomatic properties after an angry mob pelted U.S. Ambassador to Syria Robert Ford and several aides with tomatoes and eggs as they visited a prominent opposition figure.

Neither Ford nor his aides were injured but several armored embassy vehicles were badly damaged before Syrian security forces arrived and were able to escort them to safety.
Administration officials said they had lodged formal protests with Syrian authorities over the incident but there were no plans to recall Ambassador Ford from Damascus.

They also said Ford would continue to meet opposition figures and press the government to end its brutal six-month crackdown on pro-reform demonstrators. The crackdown led President Barack Obama and some European leaders to demand that Syrian President Bashar al-Assad step down.

“It is not an isolated incident, it is part of a pattern that we’ve seen,” State Department spokesman Mark Toner told reporters.

He added that it was “part of an ongoing campaign to intimidate our diplomats as they were undertaking their normal activities and duties. Intimidation by pro-government mobs is just not civilized behavior. It’s an inexcusable assault that reflects intolerance on the part of the regime and its supporters.”

Toner said the assault reflected “the same kind of intolerance that we see that stirs the regime to use arrests, beatings and tortures and killings against those whose crime is only exercising their universal rights to gather peacefully and express their opinions.”

At the White House, spokesman Jay Carney said the attack was “unwarranted and unjustifiable.” He praised Ford for bearing witness to the “brutality of the Assad regime” and putting “himself at great personal risk to support the legitimate aspirations of the Syrian people.”

Ford and his colleagues had left the embassy to visit opposition leader Hassan Abdul-Azim, who heads the outlawed Arab Socialist Democratic Union party. Trying to keep a low profile, they parked about a block away and walked to the office where they were confronted by the crowd, according to Toner.

Abdul-Azim said Ford was inside his office when the Assad supporters tried to force their way in, breaking some door locks. Office staff prevented them from rushing in, but the ambassador was trapped inside for about three hours by the hostile pro-government protesters outside. Ford called the U.S. embassy for help and alerted Syrian authorities to the situation. But Syrian security forces did not show up for more than an hour.

Syria’s Foreign Ministry said the U.S. Embassy informed the ministry that Ford was confronted by protesters when he visited Abdul-Azim. The statement added that the ministry immediately contacted security authorities, who “took all measures needed to protect the ambassador and his team and secured their return to their work in accordance with Syria's international commitments.”

Ford has angered the Syrian regime in past months by visiting a couple of the protest centers outside of Damascus in a show of solidarity with the anti-government uprising. The latest incident could further raise tensions between Washington and Damascus, which has accused the United States of helping incite violence in Syria. In August, Obama demanded Assad resign, saying he had lost his legitimacy as a ruler.

The attack on Ford came five days after government supporters threw eggs and stones at France’s ambassador as he left a meeting in Damascus with a Greek Orthodox patriarch. Ambassador Eric Chevallier was unharmed.

Tension between the West and Syria – Iran’s closest Arab ally - have been rising for months.

Washington and the European Union have imposed sanctions on some Syrian officials, including Assad, because of Assad’s crackdown that has left some 2,700 people dead, according to the United Nations.

A trip in July by Ford and the French ambassador to the central city of Hama to express support for protesters drew swift condemnation from the Syrian government, which said the unauthorized visits were proof that Washington was inciting violence in the Arab nation. Authorities then warned both ambassadors not to travel outside the capital without permission.

A month later, the Obama administration brushed off a complaint by Syrian authorities that Ford violated their travel rules by leaving Damascus without permission. The Syrian foreign ministry registered concern over Ford's trip in August from Damascus to the southern village of Jassem, where he met opposition activists.

Occupy Wall Street protesters driven by varying goals

Almost two weeks into an anti-greed sit-in, the 'leaderless resistance movement' is at a crossroads.

Michael Moore and Susan Sarandon have dropped in. A seasoned diplomat dispenses free advice. Supporters send everything from boxes of food and clothes to Whole Foods gift cards. They even have their own app, for the legions of fans following them on iPhones and Androids.

Nearly two weeks into a sit-in at a park in Manhattan's financial district, the "leaderless resistance movement" calling itself Occupy Wall Street is at a crossroads. The number of protesters on scene so far tops out at a few hundred, tiny by Athens or Cairo standards. But the traction they have gained from run-ins with police, a live feed from their encampment and celebrity visits is upping expectations. How about some specific demands, a long-term strategy, maybe even … office space?

So far the group, which generally defines itself as anti-greed, has none of those.

"At a certain point, there's a valid criticism in people asking, 'What are you doing here?'" protester Chris Biemer, 23, said on Wednesday, Day 11 of the demonstration. In an exchange that illuminated one of the dilemmas that any movement for change faces in trying to sustain momentum, Biemer and protester Victoria Sobel made it clear they had different visions for Occupy Wall Street.

Biemer, who recently moved to New York from Florida with a degree in business administration, says that ideally the group should team up with a nonprofit organization and get office space.

"It's possible to stay here for months or longer, but at some point we're going to become a fixture," he said of their home in Zuccotti Park, a privately owned, publicly accessible plaza dotted with trees and flower beds about midway between the Stock Exchange and the former World Trade Center site.

Sobel, who like Biemer serves on Occupy Wall Street's finance committee, disagrees and said the group's strength lies in its ability to remain highly visible and in a place where anyone can visit and participate. The 21-year-old New York University student happily reported Wednesday that bookshelves had been delivered to the UPS store where the group receives mail. They'll sit beneath a tarp in the park, all part of Sobel's vision to solidify the group's foothold.

"It's a moment of clarifying for us," Sobel said, confident that as autumn's chill turns to winter's subfreezing temperatures, Occupy Wall Street will stay put. "We'll layer," she said with a laugh, when asked how they'll manage the cold.

The protest, which evolved from a network of individuals and groups galvanized by the demonstrations in Egypt last winter, has moved far beyond what it was on Sept. 17, when police barricaded the streets outside the Stock Exchange to prevent a march there to protest corporate greed. A map in Zuccotti Park pinpoints scores of other cities with Occupy Wall Street events either underway or planned, including sit-ins planned for Los Angeles on Saturday and Washington on Oct. 6.

But its proximity to the real Wall Street and its series of high-profile visitors have made the New York protest the focal point. So have inflammatory videos posted online that show a New York police officer using pepper spray on some protesters last Saturday.

Now, its settlement has gelled into an organized community that hums along almost Zen-like, coexisting with the city that rages around it and ignored by many either too busy or too uninterested to stop. Harried commuters seem to barely notice the mishmash of humanity a few feet away as they rush down the sidewalks skirting the park.

Tourists stroll in to snap pictures and read the protest signs scattered across the ground, then wander off to their next sightseeing stop. Executives drop in on lunch breaks to talk politics and economics. Police hang back on the sidewalks, and follow along when groups of protesters stage marches.

Protest numbers vary as people drift in and out of the park. Some live in the area and come by for a few hours each day or week. Others stay there around the clock, their sleeping bags, guitars and clothing bundles spread on the ground. On Wednesday, they included a sleepy-eyed young man in a rumpled T-shirt cuddling a pet rat, and a woman who pranced about in her underwear.

There are committees, including one for finance, food and comfort, which ensures that anyone who needs blankets, dry clothing or perhaps a hug gets it. There are twice-daily meetings called general assemblies, where anyone can make a brief announcement. The assemblies draw everyone together in a tight huddle. To avoid violating a ban on bullhorns, the crowd obediently repeats in unison every phrase uttered by the main speaker, to ensure everyone hears.

Each morning, protesters stage a "morning bell march" through the neighborhood, to coincide with the clanging at 9:30 a.m. of the bell that marks the start of trading at the Stock Exchange. Most days, a "closing bell" march also takes place in the afternoon.

On its website, Occupy Wall Street describes itself as a "leaderless resistance movement" drawn from people of all backgrounds and political persuasions.

"The one thing we all have in common is that we are the 99 percent that will no longer tolerate the greed and corruption of the 1 percent," the website says. The posters in Zuccotti Park speak to the lack of a narrow platform: "End financial aid to Israel"; "End greed, end poverty, end war"; "No death penalty"; "Tired of racism."

Some supporters of the premise wonder how far Occupy Wall Street can go in galvanizing others if it does not translate its anger into specific demands.

"I see something beautiful here. I've never had a more interesting political debate," said Carne Ross, a former British diplomat who resigned in protest over the invasion of Iraq, and who now owns a consulting business in New York. But Ross, who stops by regularly to advise Occupy Wall Street, said it needs "far broader outreach" and a narrower message.

"They need to get a message to people who can't be here," Ross said.

"I'd prefer to see a list of demands," one fan wrote on the Occupation Wall Street Facebook page, echoing the concerns of a woman who tweeted something similar to Moore as he did his MSNBC interview. She asked for "some specific, tangible goals."

Michael T. Heaney, a University of Michigan political science professor who has studied social protest movements, said such groups often bump up against pressure to become more focused and to either build or join institutions that can support them.

"What you're talking about is a degree of buying into a political system," Heaney said. "But the more you use tactics that we recognize as getting you influence, the more you buy into the system, and the more you buy into the system, the more you open yourself up to compromise."

In Occupy Wall Street's case, Heaney said demands could be as vague as simply calling for financial bailout programs to apply to individuals rather than banks.

Most of those in Zuccotti Park, though, don't see the need for a change in tactics. At least not yet.

"There isn't a consolidated message, and I don't think there needs to be," said Andrew Lynn, 34, who drove the three hours from his home in Troy, N.Y., to help the demonstrators' media team.

On Wednesday, he hunched over a laptop sheltered from the clammy air by an umbrella. A generator rumbled beside him, ensuring the group's activities continued to stream live to audiences.

Added Kobi Skolnick, a young Israeli American who by Wednesday was in his ninth day of participating in the protest: "I think the main thing we're doing is knocking on the walls of ignorance in this country so people wake up."

RIO- O presidente da CBF, Ricardo Teixeira, deu entrada no início da noite desta quinta-feira na emergência do Hospital Pró-Cardíaco, em Botafogo. De acordo com a assessoria de imprensa da unidade de saúde, o dirigente apresentava dor abdominal e passa neste momento por avaliação clínica de seu cardiologista, Jorge Castro y Perez. Ele passou o dia em Brasília, onde participou de reuniões. Assim que chegou ao Rio, Ricardo Teixeira foi para o hospital. O dirigente entrou caminhando no Pró-Cardíaco, junto a seus dois seguranças. Segundo o hospital, Perez adiantou que Teixeira - que está acompanhado por sua esposa - deverá ficar em observação no hospital por, pelo menos, 48 horas.

Google AnalyticsGoogle made two big announcements today around their Analytics service: a real-time chart which we covered earlier and a new premium analytics service. The premium analytics service is geared towards Google’s largest customers and includes the following items listed on their announcement posting:
  • Extra processing power – increased data collection, more custom variables and downloadable, unsampled reports
  • Advanced analysis – attribution modeling tools that allow you to test different models for assigning credit to conversions
  • Service and support – experts to guide customized installation, and dedicated account management on call – all backed by 24/7 support
  • Guarantees – service level agreements for data collection, processing and reporting
So basically for a fee, Google will provide a stronger server to run your custom reports, a dedicated account manager and a 24/7 support and service level agreement (SLA). The one thing Google didn’t note in their announcement post was the cost for the premium analytics offering.
I have received tips from several sources noting that the price for the premium analytics service is A WHOPPING $150,000/year.
If your company wants to use Google Analytics Premium, you can either signup directly with Google or with one of their resellers. Be ready to bring your checkbook.
For comparison, many report paying over $100K a year for Adobe’s Omniture SiteCatalyst offering. I can’t remember what we used to pay for Webtrends Enterprise at my old job but it was in the same ballpark.

First Camaro ZL1 Goes for $250,000

The first Chevrolet Camaro ZL1 garnered a cool quarter-mil when it went across the auction block at the Barrett-Jackson Auction in Las Vegas over the weekend.

The most powerful version of the Chevy muscle car ever built will reach showrooms early next year at a decidedly more affordable price – anticipated to be somewhere around $50,000.  But the very collectible first retail Camaro ZL1, offered by a Sin City dealer, was aimed at raising money for the YMCA of Southern Nevada.

Curiously, it was another dealer who anted up the winning bid.  Rick Hendricks, owner of Hendricks Motorsports and chairman of the Hendricks Automotive Group, took the gavel at $250,000.  He’ll have to pony up the money now though he’ll only take delivery of his new Chevy Camaro ZL1 sometime during the first quarter of 2012.

The wait should be worth it considering the ZL1 Hendricks will get will be the only one produced with a Carbon Flash Metallic exterior. It will be the 69th ZL1 to roll off the line at the Oshawa Assembly Plant, in tribute to the legendary 1969 Camaro ZL1, of which only 69 were produced.

The ZL1 is the long-awaited Chevy response to the likes of the Mustang Shelby GT.  The Camaro ZL1’s 6.2-liter supercharged V-8 will make a jaw-dropping 580 horsepower and 556 lb-ft of torque.  That is, incidentally, 24 hp more than the same LSA V-8 makes under the hood of the Cadillac CTS-V thanks to improvements to the intake system, supercharger and intercooler.

The car Hendricks will drive home will come with a 6-speed manual gearbox, though the ZL1 will also be offered with a 6-speed automatic.

“Our family has been involved with the YMCA for more than 25 years,” said Greg Heinrich, president of Fairway Chevrolet, explaining the Las Vegas retailers decision to put the one-of-a-kind ZL1 on the auction block.

The original '69 Chevrolet Camaro ZL1 clones sold for a grand total of $7,200 – closer to $45,000 adjusted for inflation today.  But one of those rarities commanded a record $840,000 bid when it went up for auction in 2005.  So, maybe Hendricks got a steal after all.

The first 2012 Camaro ZL1 put up for sale brought $250,000 at the Barrett-Jackson auction in Las Vegas on Sept. 24.
Fairway Chevrolet-Buick-GMC put the new ZL1 up for auction, with proceeds going toward the Southern Nevada YMCA. The car was bought by Hendrick Motorsports owner Rick Hendrick, who expects delivery in the first quarter of next year. His will be the only Chevy Camaro ZL1 coupe of the 2012 model year with a "carbon flash metallic" exterior. Also, it is the 69th ZL1 from the Oshawa Assembly Plant, in honor of the limited 69 production copies of the 1969 ZL1.
"Like the original, the 2012 Camaro ZL1 introduces a performance benchmark for the street and the track," Chevy spokesman Russ Clark said. "Offering the 69th Camaro ZL1 at auction was a fitting tribute to the 1969 model."
The 1969 ZL1 was the most elite Camaro ever produced, according to General Motors. The all-aluminum big-block engine used was originally developed for Corvette race cars in the late 1960s. It was similar to the Chevrolet L-88 427 engine, except the ZL1's aluminum block reduced the overall weight by more than 100 pounds. The 1969 ZL1 was rated at 430 hp, but GM says it was known to produce more than 500 hp.
The 2012 Chevrolet Camaro ZL1 is equipped with a supercharged 6.2-liter V8 engine that delivers 580 hp and 556 lb-ft of torque.

Carrefour vai abrir 20 lojas do Atacadão por ano, diz sindicato

Em reunião com o Sindicato dos Comerciários de São Paulo na tarde de hoje, o presidente do Carrefour, Luiz Fazzio, ressaltou que o Carrefour pretende se dedicar, nos próximos anos, à expansão da bandeira Atacadão. Serão abertas 20 lojas por ano entre 2012 e 2014.
"O presidente do Carrefour também garantiu que a empresa não pretende se desfazer dos seus ativos no Brasil, uma vez que o negócio no principal mercado deles, a Europa, enfrenta adversidades", disse Ricardo Patah, presidente do Sindicato.
Na metade do ano, a rede ensaiou uma fusão com o Grupo Pão de Açúcar, que acabou frustrada por conta do sócio --o grupo varejista francês Casino--, que desaprovou a iniciativa.
No país, o Carrefour também foi sondado pelo Walmart.
Ao sindicato, Fazzio teria prometido ainda não fechar mais lojas no país. Este ano, O Carrefour fechou oito lojas no interior de São Paulo e outras duas na capital. Essas duas lojas, no Ipiranga e no Morumbi, geraram a demissão de 600 pessoas.
Aos demitidos, segundo Patah, a empresa estendeu a vigência do plano de saúde por mais três meses (além dos três meses garantidos por lei).

Primeiro foi o Alzheimer, que pouco a pouco se apropriou da memória de Ruth Escobar, 75. A atriz e produtora cultural luso-brasileira foi fundamental para o desenvolvimento do teatro moderno do país. Concebeu, entre outras obras, o primeiro festival internacional do gênero, apresentando ao país o trabalho de Bob Wilson e Jerzy Grotowski, entre outros encenadores de prestígio mundial.
A artista foi diagnosticada com a doença em 2000, um ano antes de criar uma versão de "Os Lusíadas", de Luís Vaz de Camões, seu último trabalho nos palcos, como produtora.
Agora é a memória de seu legado cultural que, segundo Inês Cardoso, uma das filhas de Ruth Escobar, está em deterioração. Cardoso aponta negligência na administração do patrimônio da artista, que ficou a cargo do escritório de advocacia Pinheiro Sales após determinação da Justiça, há cerca de cinco anos. "Programas de espetáculos, folhetos, fotos, está tudo estragando por conta de umidade e sujeira em uma das casas da minha mãe, na rua Treze de Maio", diz Inês à Folha.
"Está tudo caindo aos pedaços. Tive que brigar para convencer a curadora a trocar o piso de madeira do terraço. No estado em que estava, poderia machucar alguém", completa.

Sara Leal Might Be Seeking Cash For Story

Is she or isn't she? Some media outlets are reporting that Ashton Kutcher's alleged one-night stand, Sara Leal, is seeking huge cash to spill the deets on her hook-up.
Plenty of people have weighed in with their thoughts about the alleged one-night stand married Two and a Half Men star Ashton Kutcher had last weekend in San Diego with pretty blonde Sara Leal. One person has been noticeably quiet about it: Leal.

Now we know why: Kutcher’s alleged hook-up wants a reported $250K to tell her side of the story.
"Wow! I received confirmation. I can say this is 100% true… Sara Leal wants $250,000 for the story/details which is out of my price range. Email me if you need her contact… you better hurry before Demi Moore strokes her a check to make this go away," TheDirty.com founder Nik Ritchie wrote on Wednesday.
Star magazine backed that up with a quote from a source.
"Sara is talking to multiple media outlets for a deal. She wants $250,000, but the offers haven’t been as high. What she really wants is to get a payoff from Ashton. She has reached out to Ashton’s team."

Ritchie broke the story earlier in the week -- and plenty of Leal's 'friends' and enemies have come out with info on her.
"Ok, I’m actually friends with Sara and I was with her and Ashton at the Hard Rock Hotel and know everything that happened," a friend wrote in an email to Ritchie, posted on his site Thursday morning. "Why are you telling the media information that isn’t true? They didn’t take away all of our phones, we didn’t get there at 4 a.m., the only girls there were Sara and I after 4-5 a.m.… Sara is not trying to get money, she just wants people to leave her alone. I blame Ashton 100% for what he did. I saw it all. Just don’t listen to everything you believe and leave it to us to handle it."
Unfortunately, that’s not likely when Kutcher and Demi Moore are involved.
It’s impossible to tell which side is telling the truth here. Leal reportedly hired celeb lawyer Keith Donaldson who advised her to delete or block her social media accounts.
Meanwhile, Kutcher cryptically addressed the rumors with a tweet.
"When you ASSUME to know that which you know nothing of you make an ASS out of U and ME," he wrote.

Following TheDirty.com's report alleging that Ashton Kutcher cheated on Demi Moore when he slept with 23-year old blonde Sara Leal, photos of that may show the two leaving a nightclub, dated June 1st, have emerged online.
Radar Online reported on Wednesday that Leal was meeting with an attorney Tuesday night; the site also reports that she has deleted all of her social media accounts.
Kutcher and Moore did not spend their 6th wedding anniversary together; he partied in California while she spent time in New York.
The report on TheDirty is one of two allegations of infidelity against Kutcher; a report in Star Magazine alleges Ashton Kutcher cheated on wife Demi Moore with a 21-year old brunette.
While neither Kutcher or Moore have officially commented on the allegations, there have been possible hints left via social media. On September 23rd, Moore tweeted a quote from Greek philosopher Epictetus, writing, "When we are offended at any man's fault, turn to yourself & study your own failings. Then you will forget your anger."
Early Thursday morning, Kutcher tweeted a link to Public Enemy's song "Don't Believe The Hype," which contains the lyrics, "Some media is the wack/as you believe it's true/it blows me through the roof/suckers, liars, get me a shovel/some writers I know are d--- devils/for them I say, don't believe the hype."
He just now (1:29 PM EST) tweeted, "When you ASSUME to know that which you know nothing of you make an ASS out of U and ME."
Married since 2005, the couple was hit with allegations of infidelity in 2010, when Star claimed Kutcher had cheated on Moore. They also had texts Kutcher allegedly sent another woman, 21-year old Brittney Jones. Kutcher slammed that report. "I think Star magazine calling me a 'cheater' qualifies as defamation of character. I hope my lawyer agrees," he wrote on Twitter. "STAR magazine - you don't get to stand behind 'freedom of the press when you are writing fiction."

LOS ANGELES, sep. 29 (UPI) -- Ashton Kutcher desmintió los rumores que apuntan a un quiebre matrimonial y eventual divorcio de su esposa, la actriz Demi Moore.

Así lo expresó el actor, actualmente protagonista de la serie de televisión Two and a Half Men, aunque de manera indirecta. Ello porque publicó un enlace a su cuenta en Spootify, el servicio musical por Internet, que permite escuchar la canción Don't Relieve The Hype (No creas lo que se publica) de Public Enemy.

Por su parte, tanto el representante de Kutcher como el de Moore han declinado emitir declaraciones; y se han limitado a enfatizar que "el matrimonio es un asunto de ambos."

Sin embargo, las declaraciones del actor no han logrado apaciguar los rumores sobre que estuvo de fiesta con amigos y no celebró su sexto aniversario de bodas junto a su esposa; como tampoco el que Demi Moore haya asistido sola a Nueva York al estreno de uno de sus cortometrajes.

Según el periódico 'The Daily', la pareja se ha distanciado, o virtualmente separado, tras las fuertes sospechas de Moore de que Kutcher le ha sido infiel.
La supuesta infidelidad se llama Sarah Leal, tiene 23 años y, aparentemente, es la razón por la cual la pareja no pasó junta la semana pasada la fecha de aniversario de su boda.
Según 'The Daily', hace meses que Moore y Kutcher no viven juntos y el actor le confirmó a Leal que, efectivamente, están separados, aunque ninguno de los representantes de la pareja de actores ha querido confirmarlo. Ni desmentirlo.
"Van rumbo al divorcio", aseguró el diario, puntualizando que será una etapa muy reñida, porque Moore tiene una fortuna de 150 millones de dólares y la de Kutcher asciende a 140 millones, con todas las posibilidades de incrementarse si el actor sigue protagonizando el show televisivo 'Two and Half men', donde sustituyó al actor Charlie Sheen, cuyo personaje se comportaba continuamente como Moore ahora cree que hace Kutcher.

Just one day after reports claimed the "Two and a Half Men" star cheated on wife Demi Moore on the day of their sixth wedding anniversary, new photos show Kutcher out with a woman who looks eerily similar to his alleged mistress.

Pictures taken on June 1 show Kutcher behind the wheel of his car with a woman in the backseat who bares a striking resemblance to Sara Leal, a 23-year-old blond coed whom TheDirty.com claims the actor slept with on Sept. 24 during a boys trip to San Diego.

HE CHEATED ... ON HER?! STARS WHO HAVE WANDERING EYES
Though it was assumed Kutcher had first met Leal during his recent getaway, photos taken of the two over the summer argue a different scenario. The two were photographed leaving the "Beacher's Madhouse" show together at L.A.'s Roosevelt Hotel.
Following a full day of silence from the superstar couple, Kutcher tweeted a link to Public Enemy's "Don't Believe the Hype" during the early hours of Thursday morning.
DEMI MOORE SKIPS FILM EVENT IN LIGHT OF ASHTON CHEATING RUMORS
Without further comment, the actor's vague tweet could be interpreted as a response to reports that he cheated on his wife on the day of their six-year wedding anniversary.

The song's lyrics include: "Some media is the wack/as you believe it's true/it blows me through the roof/suckers, liars, get me a shovel/some writers I know are d--- devils/for them I say, don't believe the hype."
He followed with another tweet, saying, "When you ASSUME to know that which you know nothing of you make an A-- out of U and ME."

"Ashton and Demi have separated and the marriage is over," an insider told Star magazine. "It was definitely a long time coming, but they're finally done for good.

"Ashton was a serial cheater, and Demi just couldn't take it anymore," the source added. "She didn't deserve to live that way. It's a painful time for Demi."
Kutcher, 33, and Moore, 48, have reportedly been living apart for months, and according to Star, they're about to embark on an estimated $290 million divorce battle.

The couple has been living on opposite sides of the country, with Kutcher filming "Men" in Los Angeles and Moore working on the upcoming film "Magic Mike" in New York.

Considering the allegations, Moore's recent behavior seems suspect.

On Sept. 12, she tweeted a photo of her own naked back along with the message: "remember.....you've got your own back." And on Sept. 23, she posted a quote from Greek philosopher Epictetus, writing, "When we are offended at any man's fault, turn to yourself & study your own failings. Then you will forget your anger."
Kutcher was noticeably absent Monday night in New York when Moore celebrated the premiere of Lifetime's "Five," a series of films in which she helped direct. With divorce rumors escalating, the actress was a no-show at her own film event in L.A. Tuesday night.

This isn't the first time a woman has claimed to have had an affair with Kutcher.

Last year, Brittney Jones alleged she had sex with Kutcher at the home he shared with Moore only a few days after they first met at a Hollywood bowling alley. Jones also claimed that Moore and Kutcher had an open relationship and shared lovers.

At the time, the pair denied the allegations through their lawyer. However, reps for both stars have not responded to the Daily News' request for comment on the recent reports.

Pictures have surfaced showing Ashton Kutcher with a blonde woman who resembles his alleged lover Sara Leal three months before their reported nightclub ‘fling’.
The actor was seen leaving the Roosevelt Hotel with the woman back in June after watching the Beacher’s Madhouse show with friends.
In the unearthed photographs, the 33-year-old is seen driving off with her seated in the back seat of his car.
His wife, Demi Moore, 48, was not in attendance.

Friends have said Kutcher's marriage to Moore is in crisis with one magazine, Star, saying they have already separated.
Meanwhile, some sources are saying that, should Kutcher and Moore's marriage end, the couple could be battling it out in a bitter $290 million divorce.
Sources also tell Star that Moore and Kutcher have been living largely separate lives, with a source saying it was clear that their marriage was 'beyond help,' when Kutcher visited Moore in New York City recently.
It is the second time Kutcher has been accused of cheating on his  wife.
A year ago Brittney Jones, 21, said she had sex with the actor at the Beverly Hills home he shares with his wife while she was away.
Moore, who is 15 years senior to her husband, has refused to comment on the claims.
She and her husband were last seen together two months ago.
Her Twitter posts have turned much darker in recent weeks.
Earlier this week she posted a picture of her face with her eyes closed and the words: 'I see through you.'
On that same night of Kutcher's alleged fling, Moore was tweeting from the East Coast, where she is temporarily based.
She shared a quote from Greek philosopher Epictetus on September 23, writing: 'When we are offended at any man's fault, turn to yourself and study your own failings. Then you will forget your anger.'
Leal has been talking with Beverly Hills lawyer Keith Davidson who represented Betty Ford worker Dawn Holland following her spat with actress Lohan.
The pay-off wanted by Leal will be similar to that negotiated by nightclub hostess Rachel Uchitel after her affair with Tiger Woods was exposed.
Uchitel,35, received a reported $10m from the golf star in return for not talking about their affair.
She later had to pay back the money after appearing on Celebrity Rehab with Tiger's lawyers saying she had breached the confidentiality clause.

Pictures have emerged showing Ashton Kutcher partying in a San Diego nightclub on the night of an alleged fling with a pretty blonde.

The husband of Demi Moore was at Fluxx last Friday night where he partied until the early hours of Saturday - the Hollywood couple’s sixth wedding anniversary.

A woman, identified by various U.S. media outlets as 23-year-old Sara Leal, claims to have had a late night liaison with the Two And A Half Men star after meeting at the venue.

The actor and social media entrepreneur, 33, is yet to address reports of the fling and allegations his marriage to Moore, 48, is over. 
In what may be a cryptic nod to the rumours, Kutcher tweeted a link to his Spotify account on Wednesday where he was playing the Public Enemy song Don't Believe the Hype.
