Charges of possessing child pornography against Brian Kuipers, 23, of Bismarck have moved to federal jurisdiction.
Kuipers was charged Wednesday in U.S District Court with one count of receipt of material depicting the exploitation of a minor and two counts of possessing material depicting the exploitation of a minor.
U.S. Magistrate Charles Miller ordered bond conditions that require Kuipers be electronically monitored, that he have no unsupervised contact with minors, he cannot possess firearms, have no use of a computer and attend any future hearings, said assistant U.S. Attorney Gary Delorme.
Kuipers is not being held in custody at this time, Delorme said.
The next court hearing on the case is pending, he said.
Kuipers was arrested in late October for allegedly having 45 child pornography videos on a computer system. Kuipers' computers were seized and sent for forensic examination.
He is accused of collecting and disseminating child pornography, which showed children as young as age 2 being abused.
Kuipers’ defense attorney Jodi Colling said she will file to obtain materials U.S. prosecutors have against Kuipers.
She said that South Central District Judge Donald Jorgensen dismissed seven counts of Class C felony possession of certain materials prohibited at the district court level.
Colling said the $50,000 bond posted for his release in South Central District Court had been refunded to the person who paid it for Kuipers’ release.
If convicted in federal court of receiving the material, Kuipers could face a maximum sentence of 20 years in prison, have five years to life of supervision and be fined $250,000.
For each count of possessing the material, he could face a maximum sentence of 10 years of prison, have five years to life of supervision and be fined $250,000.
