O americano David Goldman, pai do menino Sean, 9, dará uma entrevista exclusiva à rede de televisão NBC na manhã de segunda-feira (28) no matutino "Today", em que ele falará com a apresentadora Meredith Vieira. A segunda parte da entrevista será exibida no "Dateline", no dia 8 de janeiro, em um especial de duas horas.


De acordo com informações do blog do correspondente Sérgio Dávila, da Folha em Washington (EUA), a emissora mostrará imagens exclusivas do reencontro de David com o filho no consulado americano no Rio.

A emissora pagou o avião fretado que levou Sean e David do Rio para Orlando, com um custo estimado de até US$ 70 mil, e é a única com acesso a eles. O pai do menino fez um acordo de exclusividade com a emissora.

O advogado da família brasileira de Sean disse que o menino enviou uma mensagem por celular afirmando que chegou bem aos Estados Unidos. Ele embarcou com o pai, o americano David Goldman, na quinta (24), após decisão do STF (Supremo Tribunal).

Segundo Sérgio Tostes, a mensagem enviada não trazia mais detalhes. Na sexta-feira (25), a avó materna do menino, Silvana Bianchi, afirmou que ainda não tinha recebido notícias de Sean desde o seu retorno.

Visitas

A família brasileira de Sean disse ainda na última sexta (25) que pretende lutar para obter direitos de visitação ao neto. Silvana voltou a afirmar que espera o apoio do governo brasileiro para assegurar o contato com a criança, porém, ela não descarta contratar um advogado americano para ajudar no caso.

"Se porventura eu não tiver o apoio do governo brasileiro, o que é absolutamente impensável, nós vamos contratar um advogado em Nova York", afirmou.

"Eu espero que os EUA deem a nós a mesma coisa que o Brasil deu ao David, é o mínimo que eu espero. Pra mim foi um golpe muito duro, mas assim que for possível a liberação da visita, eu vou", afirmou à Folha Online. À NBC, Goldman já afirmou que irá permitir que a família brasileira o visite. "Levará um tempo, mas não vou negar a eles que se encontrem", disse o pai.

Tumulto

O avô paterno do menino Sean, 9,--Barry Goldman--, acusou a família brasileira do garoto de o expor à imprensa no momento da entrega da criança ao pai, David Goldman. Em entrevista a uma TV local nos Estados Unidos, ele afirmou que o americano preparava uma transição discreta, diferente do tumulto ocorrido em frente ao consulado americano do Rio.

Na entrevista, o avô disse ainda que, com a família paterna, Sean receberá apenas amor e carinho.

A criança, que vivia no Brasil desde 2004, é alvo de uma disputa diplomática entre o Brasil e os Estados Unidos.

Aqui no Brasil, Patrícia Poeta conversou com a avó materna de Sean, Silvana Bianchi, sobre as mesmas questões discutidas com o pai da criança. O padrasto João Paulo Lins e Silva não quis gravar entrevista alegando que o processo está sob segredo de justiça.
A mãe de Bruna Bianchi, Silvana Bianchi, recebeu a equipe do Fantástico na casa onde vive com o marido, o genro João Paulo e o neto Sean, no Rio de Janeiro.

Fantástico: Como era a relação da sua filha Bruna com o ex-marido, David?

Silvana Bianchi: No início, o casamento foi bem, até depois do nascimento do Sean. A partir daí, o casamento começou a deteriorar. A Bruna sofria muito. O casamento não ia realmente bem.

De quem era a casa onde eles moravam nos Estados Unidos, pertencia a quem?

A casa pertenceu ao casal. Foi um bem comprado após o casamento. A hipoteca ele pagava, e ela sustentava toda a parte da casa: a comida, a escola, o seguro-saúde. Era tudo por conta dela. Inclusive era por conta dela a baby-sitter que eles tinham lá, para ficar com Sean, enquanto ela ia trabalhar na escola.

Por que a Bruna decidiu deixar o marido nos Estados Unidos e vir morar no Brasil com o filho?

Ela veio para cá para o Brasil em viagem de férias. Ia passar duas semanas aqui, e o combinado era que o David viesse passar a terceira semana junto. Ele, por razões não sei se foram profissionais, alegou que não poderia vir. Então, ela permaneceu aqui e logo dois ou três dias depois que ela chegou, ela disse: ‘Mamãe, eu não vou voltar para os Estados Unidos’. Então, eu disse: ‘Bruna, você precisa ver a parte jurídica disso. Você tem que procurar um advogado’. Foi. Ela procurou o advogado e imediatamente ela obteve a guarda provisória do menino.

Nesse período vocês pagaram ao David US$ 150 mil. Por que vocês fizeram esse pagamento a ele?

Essa questão, são duas questões diferentes. A Bruna tinha um processo e o David, de uma maneira tendenciosa, colocou um processo em cima de nós, avós, eu e meu marido, como co-autores de um sequestro.

Então houve um acordo para que ele tirasse o nome de vocês do processo em que vocês também seriam réus.

Exatamente.

E a Bruna? Ela também não quis ir para os Estados Unidos tentar buscar um acordo?

A Bruna tinha muito medo de ficar retida nos Estados Unidos se ela fosse.

Ela tinha medo também do David?

Tinha bastante medo do David, porque as brigas eram um pouco violentas e ela tinha medo de ser agredida.

Ela relatou algum acontecimento, algum caso de violência em que ela foi vítima?

Ela não, mas o Sean sim. O Sean lembra de um episódio em que eles brigaram. Ele deu um soco e quebrou o armário. Isso me foi relatado pelo Sean, não pela Bruna.

Depois que a Bruna veio para o Brasil, o David falsificou os cheques dela?

Nós estamos com cópias de cheques que a gente imagina que tenham sido falsificados.

O David afirma também que mandou presentes para o filho e que esses presentes nunca foram entregues ao Sean por vocês. Isso é verdade?

Não. Houve uma caixa que voltou. Porque todas essas caixas que chegam com presente, você tem que ir ao correio, retirar essas caixas e pagar uma taxa para a Receita federal. Não entregam estas caixas em casa. Você tem que ir ao correio. Uma dessas caixas nós não estávamos no Rio. Veio, chegou o papel, acho que o papel se perdeu aqui em casa, estávamos viajando, e essa caixa foi devolvida. Mas eu tenho o comprovante das outras caixas que nós fomos lá e retiramos e pagamos as taxas para a Receita federal. Eu tenho isso guardado.

Ele podia visitar o filho?

Claro que podia visitar o filho. Foi oferecido para ele passagem e estadia. Ele jamais em quatro anos e meio veio visitar o filho dele.

Quantas vezes ele veio ao Brasil nesse período?

Que nós tivemos conhecimento, umas cinco ou seis, porque várias vezes ele veio ao Brasil sem nos procurar. A gente não sabia, ele não comunicava a gente que estava no Brasil.

Quantas vezes ele veio visitou o filho nessas vindas ao Brasil?

Nenhuma.

Dona Silvana, em algum momento vocês negaram ao David o direito de ver o filho?

Jamais, Patrícia, Jamais. Jamais eu faria isso. E nós fomos acusados disso durante quatro anos e meio. E outro dia, nós soubemos, por esse documento, dos advogados dele, que tinha sido orientação dos advogados dele, que ele não procurasse o filho. Ele seguiu a orientação desses advogados, não procurou o filho, e nos acusou de uma coisa que jamais fizemos.

Como a senhora acha que ele ficou sabendo da morte da Bruna?

Eu imagino que ele tenha ficado sabendo através do jornal.

Depois disso ele ligou?

Não.

Ele veio direto para o Brasil?

Veio direto para o Brasil.

E aí ele pediu para ver o filho?

Exatamente. E foi o primeiro pedido para ver o filho oficial ao juiz e foi negado, porque o juiz entendeu que naquela ocasião nenhum de nós tinha condições psicológicas de receber uma pessoa que nós não víamos há cinco anos. Depois disso houve audiência em Brasília, onde houve um acordo de visitação, entre o João Paulo e o David, os advogados do David.
E o João Paulo disse: ’Você quer visitar? Pois não. Você vai visitar. Quer visitar agora, amanhã’. O dia foi marcado. Isso foi numa sexta, na segunda ele veio. Ficou com o filho na segunda e na terça.

Nessa ocasião, o que aconteceu? Como é que foi a visita?

A visita transcorreu muito bem, e o Sean é uma criança muito afetuosa. A visita transcorreu muito alegre, muito feliz, e foi uma visita normal.

Como é que o Sean chama o padrasto?

De papai.

E o pai biológico?

Ele chama de David.

E ele sabe sobre todo esse caso?

Sabe. Nada foi escondido dele.

O que ele fala para você sobre isso?

Ele está muito ansioso, porque ele não quer voltar. De jeito nenhum. Ele está ficando com muito medo de virem aqui e arrancarem do seio da família e levarem embora.

Dona Silvana, a senhora tem acompanhado a campanha que o David tem feito pela guarda do filho nos Estados Unidos? O que a senhora tem achado dessa campanha?

Eu acho tudo muito surreal. Dentro dessa campanha existe um blog onde ele recebe doações, inclusive de cartões de crédito. Existe uma parte onde ele vende material com a estampa do Sean pequeno em caneca, boné, chaveiro e a imagem da Bruna, minha filha falecida, colocada num avental.

Na sua opinião, o que a senhora acha que é melhor para o seu neto, ficar aqui com o padrasto, o pai adotivo, e não com o pai biológico nos Estados Unidos?

O Sean aqui eu tenho que frisar que ele tem uma coisa muito importante, ele tem uma irmã de sangue, ele tem a ligação com a mãe dele nessa irmã. Se o Sean volta para os Estados Unidos, vão cortar a ligação dos irmão. Um fica aqui e outro vai para lá. Não sei. Isso me parece uma coisa muito cruel.

Dona Silvana, a senhora está preparada psicologicamente para o caso do pai biológico voltar a ter a guarda do filho e o seu neto ir de novo para os Estados Unidos?

Eu espero que o Sean fique aonde ele se sinta muito feliz e amparado aonde ele tenha muito amor e muita harmonia e muita felicidade. É isso que eu quero para o meu neto.

E que lugar é esse?

Não sei, ele vai saber, ele vai dizer para nós aonde é esse lugar. Não sou eu que vou decidir nada por ele.

Dois empresários são sequestrados no Rio

RIO - Na madrugada desta quarta-feira, um empresário do ramo de rações, de 38 anos, foi sequestrado por um grupo de bandidos em Campo Grande, Zona Oeste da cidade, segundo a Rádio CBN. Na noite desta terça, o dono de um salão de beleza em Nilópolis, na Baixada Fluminense, sofreu um sequestro relâmpago em Anchieta, no subúrbio do Rio. Ele ficou por uma hora em poder dos bandidos, que resolveram abandonar a vítima depois de bater em um microônibus.

O acidente livrou o empresário, que estava vedado, no porta-malas do carro. A polícia o encontrou quando foi checar, teoricamente, um acidente de trânsito.

- Vendaram meus olhos com minha própria camisa - disse a vítima à TV Globo.

Segundo ele, os bandidos tinham a intenção de fazer saques em agências bancárias.

O empresário do ramo de rações foi abordado quando passava em sua caminhonete Toyota, pela Estrada do Mato Alto. Os marginais teriam colidido com a traseira do seu veículo, antes de colocá-lo em outro automóvel.

De acordo com a CBN, policiais do Regimento de Polícia Montada informaram que os sequestradores abandonaram o Toyota da vítima e um Meriva roubado na mesma Estrada do Mato Alto, momentos depois da ação, e fugiram em outro carro. A placa não foi anotada.

Sean Goldman Good morning. Before I go directly into my testimony I wanted to share with you an image that has been replaying itself in my mind over and over. Congressmen (and women) who sit before this commission today, prior to becoming an elected official there must have been something that drove you to commit to your position.

You imagined that you could make a difference, you must have imagined that you could make a change for the better. Maybe through a personal experience or just your exposure to politics, somewhere something happened that compelled you to run for office with an image that you could and would in fact bring change.

Now imagine 66 American children, which is about the number of the average size of four fourth grade classes anywhere across America. One of these children could eventually be yours, a family member's or a friend's child. Imagine these children went on a field trip to Brazil for a week.

Imagine the trip is over and they are all on the bus heading to the airport looking forward to coming home. The bus reaches the airport and the children - all 66 of them - are not allowed to get off that bus. The chaperones leave the bus, the teachers, the bus driver, all get off the bus, but not the 4 classes of fourth grade American children.

Imagine the horror and pain the children experience knowing they will not be coming back to their Mom or Dad, brothers, sisters, cousins, aunts, uncles, Grandparents, friends to the home they know and love. Imagine if you can, the pain and anguish those waiting for their children to return, experience.

A bus load of 66 American children not allowed to go home... just because. Imagine the empty bus along side of them waiting to be filled with more American children; And one by one those seats also begin to fill up. You have the image, however this image is real. We need our children home. The children, our children, my child needs to come home. We need your help. We need your help.

Good morning and thank you for this opportunity.

My name is David Goldman. I was born in Philadelphia, Pennsylvania. In 1999 I married Bruna Bianchi Goldman, a dual citizen of Brazil and Italy, and a permanent US resident until her death in August 2008. We had a child together, a son named Sean Richard Goldman born May 25, 2000, in Red Bank New Jersey.

In June of 2004, I drove my wife Bruna, her parents Raimundo and Silvana Ribeiro, along with Sean to the Newark International Airport for a planned vacation that was supposed to last two weeks. During that time I was to finalize the plans for my wife's 30th birthday. I had no idea as I drove my son, my wife and her parents to the airport, it would be the last time I would ever see Bruna again and it would be over four years until I would see my son, Sean again.

Shortly after their arrival in Brazil, (my own mother remembers it was Father's Day) I received a call from Bruna. She began telling me what a great father and great guy I am and how she had no regrets about our relationship and having Sean together, but our love affair is over and she decided to live in Brazil with our son, Sean. She went on to say that if I ever wanted to see Sean again, I needed to fly to Rio de Janeiro immediately and sign a 10-page document that her lawyer drafted.

Without my knowledge Bruna had filed secret custody papers in the Rio state court, and needed me to come to Brazil to serve them. According to Bruna, the document had several demands: Sean would permanently remain in Brazil with Bruna and her family. I had to surrender my role as parent to Sean and give Bruna full custody, never go to the police in the US to file kidnapping charges, never file any custody papers in the US courts, never file for divorce in the United States and do nothing that interfered with her plan to obtain US citizenship. She ended by telling me that if I didn't meet her demands I would never see my son again and spend all my money trying.

Since my time is limited I will spare all of you the details of my experience following the shock and horror of what I had just been told by, at the time I thought was, my loving wife. It would literally take years to discover that her actions were part of a well planned and executed child abduction.

I had no idea what to do, I was raised in a loving home with parents who had been married over 40 years. Divorce, separation, and child abduction were beyond my comprehension. My concern turned solely on my son's well being. I understood that to meet the demands my wife had made and to sign the document she and her lawyers had prepared would give away every and all rights I have to my son and his rights to me, his father.

I searched for legal counsel. I researched international child abduction, I was directed to Ms. Patricia Apy, an expert in the law of international parental child abduction. We met for a consultation in which I was informed that Brazil was a signator to The Hague Convention, an international treaty signed by both the US, Brazil and approximately 80 countries worldwide.

I was told the treaty is a remedy for the swift return of a child that has been wrongfully removed by one parent from the other. I was also told that the US and Brazil had only recently signed on as Hague Treaty partners, prior to my son's abduction and that mine would be among the very first cases in Brazil.

There are two main criteria that need to be met in order to require the immediate return of the child under The Hague Convention. A child must have been wrongfully removed or retained from one Treaty country, their "habitual residence", to another Treaty country and the left-behind parent from whom the child has been abducted, must have been exercising rights of custody when the removal or retention took place.

If both of these criteria are met, the return is mandatory. The court of the abducting country only has the discretion to consider other factors and deny a return when the left behind parent has waited more than one year to request the return or the abducting parent proves by clear and convincing evidence that the country from which the child has been abducted cannot protect the child from abuse or neglect.

The court of the abducting country is prohibited from considering any disputes regarding custody. The court of the abducting country is required to return a child within a six week period to ensure the child will have as little disruption to his/her life as possible.

In my case all the criteria have been met requiring the immediate return of Sean to the US. The criteria was met, recognized and entered into the records of the Brazilian courts. Within 45 days of the date Sean was to return from vacation, the court in the United States found that Sean's removal had been wrongful and ruled Bruna and her parents must return Sean.

When Bruna refused, I filed immediately an application under the Hague Convention with the United States Department of State. Bruna and her parents each hired lawyers in New Jersey and Brazil to oppose and attempt to delay the eventual final order of sole legal and physical custody. I had to also hire private Brazilian counsel to file the judicial complaint for return as the Brazilian Central Authority had yet to seek prosecution of the matter two months after they had received the request.

The Office of Children's Issues in the State Department told me that if I engaged private counsel in Brazil to help me, I could forfeit Brazilian Central Authority assistance. I continued to be subjected to opposition and delay in Brazil. Eventually, the Brazilian court confirmed that Sean's habitual residence could only be the United States and that he had been wrongfully removed and retained.

However, they claimed that even though keeping Sean in Brazil was a violation of The Hague Convention and US law, during the year the Brazilian authorities and courts took to prosecute my case as a result of the strategic delays, Sean was "now settled" with his mother in Brazil.

The Court went on to say the mother is the most important bond and they will not separate a mother and a child. I must stress again that under the treaty law, to return a child home, to his or her habitual residence does NOT SEPARATE the child from the abducting parent, but allows the court of competent jurisdiction in this case the NJ Superior court, to address any and all custodial issues.

Although all the legal criteria under the Treaty were met to require an immediate return of my son, the Brazilian authorities and courts didn't care. There was no legal basis in either country to support the decision the Brazilian authorities made; it was a clear violation of their Treaty obligations. All the while the United States was honoring our part of this reciprocal treaty and continued to return children to Brazil, while my son and a growing number of other US children were being abducted to Brazil without ever being returned.

To date no American child has ever been returned from Brazil pursuant to a judicial decision. Nevertheless, throughout this entire time no notice was given to similarly situated parents like me, or American lawyers and judges who were addressing visitation and custody issues, which despite being described as a "Treaty partner" Brazil was simply refusing to apply the Treaty. As I testify today, the official report to the Congress from the United States Department of State, still describes Brazil as only showing "patterns of non-compliance," rather than being non-compliant.

Among others, three major flaws in the handling of the case were the failure of the Brazilian Central Authority to immediately bring the application for return and vigorously support Sean's return, the Brazilian judicial system treated the abduction as a custody dispute and the failure of both Governments to insist that the matter be handled swiftly and in keeping with International Law.

Of course, I took an appeal of the court's first decision, and during the entire appellate process and despite constant efforts through my US and Brazilian counsel to arrange parental access to Sean, under every conceivable condition, I was constantly rebuffed and thwarted. Despite the fact there were never divorce filings in the US, where we were married, without my knowledge Bruna remarried in Brazil to a lawyer.

Her new father in law, also a lawyer in Brazil, was described as an expert on international parental child abduction. He has lectured as a scholar in Brazil on how a clever lawyer can work the Brazilian legal system to produce endless delays in the courts in order to keep an abducted child in Brazil indefinitely.

He has also lectured on the psychological abuse the abducting parent afflicts on the child and I quote "will use the child as an attack missile against the left behind parent". (a copy of these lectures can be provided).

I understand that to have a country sign on to The Hague Convention Treaty and to accept their accession may seem better than to have no potential remedy for the return of an abducted/unlawfully retained child. However, if there is no actual reciprocity, and there is no accountability when there are no returns of children, the situation creates dangerous reliance by American parents on a Treaty that is nothing more than an illusion.

This is a treaty based on mutual responsibility and may be the most important international treaty based on the good will of all participating nations to recognize far beyond all other social, religious and political differences that the right of a child and parent relationship is paramount to all of us as human beings.

My case was pending in the Supreme Court of Brazil, when as many of you know, Bruna died.

Despite the incredible loss to Sean I was not given the opportunity to comfort my son nor was I informed of Bruna's death by those holding Sean. I only found out about it when someone close to me in America learned of her death when reading an article on the Internet and sent it to me.

Expecting that this long painful journey was about to end, I flew immediately to Brazil with Sean's Grandmother, my mother, to reach out to Bruna's family to extend our condolences and most importantly to comfort Sean. After several unanswered calls and attempts to contact Bruna's family, my counsel reached out to Bruna's attorneys to once again request that Sean and I reunite and begin the process for Sean's return home to America.

It was only then that we discovered that Bruna's new husband had filed two other secret applications: one to the Rio state court requesting that my and my parents' names be stricken from Sean's birth certificate and that he be named Sean's parent and simultaneously, he filed other pleadings in the Brazilian Supreme court, where the original case was pending, in Bruna's name without ever disclosing her death to the court. I was then told that we had to add Bruna's new husband to the request for Sean's return and begin the entire Treaty litigation all over again. That was over one year ago.

Last February I was finally able to see my son for the first time in over four years, after multiple court orders and despite the continued obstacles created by those who are holding my son. Despite those obstacles, our meeting was wonderful, my son and I experienced the closeness and love that I had not dared hope for.

The reunion was witnessed by Congressman Smith and US Embassy General Marie Damour and Consular officer Karen Gustafson de Andrade The reunion was also witnessed by the abductors who in response turned up their efforts of the brutal, psychological torture of my son.

Finally, on June 1st of this year, Brazil's First Instance federal Court ordered the immediate return of Sean, however, I am no closer to having my son home. His return was blocked by litigation orchestrated to prevent the court's action, by a Brazilian political party objecting to the Treaty.

I have been subjected to over 20 post judgment motions filed by Sean's abductors, designed to continue the delay and obstruction of the Treaty. Most insidiously, as their desperation grows, my son, Sean has been subjected to intense psychological pressure by his kidnappers, including transporting my helpless 9 year old son to a mental facility in order to cross examine him on film, to solicit a statement that he objects to returning to the United States.

I am encouraged and grateful that our national and state media, whose attention to this story has elevated the plight of internationally kidnapped children everywhere, have consistently refused to show these films. While Brazilian authorities have also objected to such behavior, Sean remains a hostage in the custody of his kidnappers, no closer to returning home to the United States and subjected to treatment that the federal Brazilian Judge, three Brazilian court appointed psychologists and the head of the Brazilian Union of Prosecutors has described as "psychological abuse".

Bruna died August 23, 2008. It has now been five years since Sean's abduction and over one year since Bruna died and still, a man with no blood relation to my son, a man who the Brazilian court has labeled a second abductor, prevents his return home. All the while my son, Sean, and I are still kept separated thousands of miles apart.

My parents - Sean's grandparents, his aunts and cousins in New Jersey - all of whom love Sean and desperately wait for his return - just concluded our sixth family Thanksgiving meal with an empty place setting waiting to be filled by Sean.

I cannot express my gratitude for the privilege to thank, in person, all of those who have already taken extraordinary action on Sean's and my behalf. The outpouring of support from American and Brazilian citizens alike, and citizens from countries all over the world, remind me that I do not stand alone while my son and I stare in the face this un-Godly living hell.

I thank the scores of American diplomats who quietly but persistently over the last five years used their resources with very few tools, to work for Sean's return. To your colleagues, Congressman Christopher Smith, who has provided me constant support and remained personally devoted to fight against international parental kidnapping wherever it may be occurring, and to my own Congressman, Rush Holt who has remained vigilant in keeping my case and this issue before this body as a matter of urgency.

There is now legislation introduced to this body that is enormously important, not just to me, but to the parents of the other 65 American children held in Brazil and the thousands held elsewhere. For the commitment of both Secretary Clinton and President Obama who I know have raised this issue with their counterparts, I can only express my continued gratitude.

However, I become discouraged when I see that the promises and assurances made to this body, and to our Secretary of State and our President, by Brazil, appear to be empty and Brazil continues to harbor 66 American children, including Sean, in violation of international law and it appears there are no consequences for this flagrant violation of their Treaty obligations and apparently nothing the United States government can do to protect its citizens from this theft of our children, the most vulnerable among us.

I pray that my personal tragedy will end soon so that my son Sean and I may once again know and love each other as father and son like we did for over four years prior to his abduction. I pray that Congress does not just hold hearings on this ongoing tragedy, but joins together in a bipartisan commitment to pass legislation that will ensure the U.S. government has the tools to return abducted American children immediately as the Treaty requires and that other countries learn there are serious consequences for refusing to return abducted American children.

We cannot dwell on or bring back the years we have lost, but we can hope to look forward to the remaining precious years ahead. My son Sean is still a young boy and he can heal. We can heal together, but he needs to come home now. I appeal and plead to all of you at the most basic level of human decency to respect the sanctity of a parent child relationship. Please take action to make a difference, to bring change, to bring our children home. Thank you.

Familia brasileña desea recuperar a niño devuelto a EEUU por decisión del Supremo

12:04 AM Sao Paulo.- La familia brasileña del niño de 9 años que por orden judicial fue devuelto a su padre estadounidense luego de un largo pleito judicial anunció el martes que intentará recuperar la patria potestad del menor.

Los abogados de la familia dijeron que tratarán de cumplir la pretensión de la abuela brasileña de que el menor exponga sus deseos ante una corte.

"La entrega temprana de Sean no finaliza el proceso legal", dijeron los abogados en un comunicado. "El proceso legal en Brasil no ha terminado".

El planteamiento fue rechazado inicialmente, pero la Corte Suprema no ha emitido un fallo definitivo. El máximo tribunal de Brasil reanudará sus funciones en febrero, informó AP.

Un juez de la Corte Suprema ordenó poco antes de la Navidad que el niño fuera devuelto a su padre, David Goldman, quien radica en la ciudad estadounidense de Tinton Falls, en Nueva Jersey. Padre e hijo viajaron entonces a Estados Unidos.

La saga data del 2004, cuando la esposa de Goldman, Bruna Bianchi, se llevó al menor, entonces de 4 años, a su Brasil natal. Bianchi dejó a Goldman, se divorció de él en Brasil, se casó con otro hombre y murió en el 2008, cuando daba a luz a una niña.

Goldman y su abogada Patricia Apy dijeron el martes en una conferencia de prensa en Nueva Jersey que no sabían qué tipo de reclamo judicial podría intentar la familia brasileña.

Apy dijo que si los familiares brasileños continúan la lucha legal, esto podría afectar los trámites para que visiten al niño en Estados Unidos.

"Parte de lo que vamos a esperar a ver es si van a usar su buen juicio y seguir adelante desde ahora como abuelos normales", dijo Apy.

Goldman dijo que su hijo llegó el lunes a Nueva Jersey, ansioso por salir a jugar afuera, aún con el frío viento invernal. El niño probablemente vaya a una escuela pública, aunque aún no está inscrito.

"No ha llorado, está simplemente feliz" dijo Goldman. "Tan sólo quiere divertirse y no tener toda esa presión sobre sus hombros".

Antes de la entrega del menor a su padre la semana pasada, los parientes brasileños dijeron que suspenderían el litigio judicial iniciado para mantener al niño en Brasil. El martes, sin embargo, sus abogados dijeron que la familia sólo estaba acatando la orden del juez, no suspendiendo el pleito legal.

Los abogados anticiparon que si la Corte Suprema se pronuncia en favor de la abuela, Silvana Bianchi, la decisión será transmitida a las autoridades estadounidenses para que se conozcan las preferencias del menor.

Bianchi siempre ha sostenido que el niño quería quedarse en Brasil.

Goldman dijo en una entrevista difundida el lunes por la cadena televisiva NBC que el niño estaba feliz en Estados Unidos, pero que todavía no lo llamaba "papá".

El padrastro del niño, Joao Paulo Lins e Silva, un importante abogado especialista en divorcios, recibió su custodia temporaria y logró demorar la entrega del menor a pesar de numerosos fallos a favor de Goldman.

En tanto, el martes, la Sociedad de Periodistas Profesionales estadounidense criticó a NBC por haber pagado por el avión en que los Goldman regresaron a Estados Unidos, un arreglo que dijo dañaba la credibilidad de la cadena.

La vocera de NBC Lauren Kapp dijo que la televisora sólo los invitó a viajar en un avión que ya se había contratado para llevar a sus empleados a casa para las fiestas de fin de año y que la entrevista exclusiva con Goldman se había acordado antes de esa invitación.

Ministros de Lula aproveitam feriado de Ano Novo e saem de férias

A maioria dos ministros do governo Luiz Inácio Lula da Silva aproveitou o feriadão de Ano Novo para tirar recesso do trabalho e recarregar as baterias para o início do ano eleitoral. A começar pelo próprio presidente, que só retomará suas atividades de trabalho no dia 11 de janeiro, os ministros optaram por descansar nos primeiros dias de 2010.

Lula passa o Ano Novo ao lado da família na Base Naval de Aratu (40 km do centro de Salvador), propriedade da Marinha. O presidente deve seguir amanhã para o local, onde pretende ficar hospedado durante o período de descanso. No início de 2009, Lula também se hospedou por dez dias na base militar depois de passar o Ano Novo em Fernando de Noronha (PE) --com direito a passeios de barco e banho de mar.

Na Esplanada, os ministros seguiram o caminho do presidente e pediram uns dias de descanso no início de 2010. Pré-candidata do PT à Presidência da República, a ministra Dilma Rousseff (Casa Civil) entrou em recesso no início desta semana e só retoma suas atividades no governo no dia 5 de janeiro.

Assim como Dilma, os ministros Guido Mantega (Fazenda) e Celso Amorim (Relações Exteriores) só voltam ao trabalho no início de janeiro. Amorim escolheu o exterior para saudar o início de 2010 e reassume as funções no dia 7 de janeiro. O ministro da Fazenda, por sua vez, retoma suas atividades no dia 15 de janeiro, depois do período de férias.

Os ministros Altemir Gregolin (Pesca), Franklin Martins (Comunicação Social), Jorge Félix (Segurança Institucional), Orlando Silva (Esportes) e Jorge Hage (Controladoria Geral) só voltam ao trabalho na segunda semana de janeiro, a partir do dia 11. Outros ministros tiraram a primeira semana do ano novo de folga, como José Gomes Temporão (Saúde), Carlos Minc (Meio Ambiente) e Geddel Vieira Lima (Integração Nacional).

Assim como no Executivo, o Legislativo só retoma suas atividades no início de fevereiro. Os deputados e senadores estão de folga durante todo o mês de janeiro, em recesso parlamentar. No Judiciário, as atividades também serão retomadas somente dia 1º de fevereiro. Até lá, os tribunais e órgãos judiciais funcionam em regime de plantão.

Sem a maioria dos ministros, parlamentares e integrantes do Judiciário, a Esplanada dos Ministérios ficou vazia nos últimos dias de 2009. Nos estacionamentos dos ministérios e do Congresso há vagas sobrando, ao contrário do que ocorre nos demais meses do ano.

Autorização

Lula autorizou o descanso dos ministros com o argumento de que todos devem estar prontos para o trabalho no último ano de seu governo. Embora vários ministros sejam candidatos nas eleições de 2010 --por isso terão que deixar o governo ainda no primeiro semestre--, o presidente disse a aliados que quer a sua equipe com força máxima no ano eleitoral.

A Justiça Eleitoral estabelece o mês de abril de 2010 como prazo máximo para que os ministros-candidatos deixem os cargos no governo federal. A expectativa é que Lula, como vem sinalizando a interlocutores, nomeie técnicos para concluírem os mandatos dos titulares. Lula quer privilegiar os secretários-executivos da pasta nos último dias de governo ao invés das tradicionais indicações políticas à Esplanada.

Entre os ministros que já declararam suas pré-candidaturas aos governos estaduais, estão Tarso Genro (governo do RS), Geddel Vieira Lima (governo da Bahia), Hélio Costa e Patrus Ananias (governo de Minas Gerais).

Outros integrantes do primeiro escalão do governo querem concorrer a cadeiras na Câmara e no Senado, como os ministros Reinhold Setephanes (Agricultura) e Paulo Bernardo (Planejamento).

Oferta de acupuntura no SUS cresce 122% em 1 ano

Em um ano, o Ministério da Saúde aumentou em 122% a oferta de acupuntura e de outras práticas da medicina tradicional chinesa (MTC) na rede pública. Foram realizados 216.616 procedimentos em 2008, contra 97.240 em 2007.

O crescimento das chamadas práticas integrativas e complementares no SUS, que reúne também terapias como a homeopatia e o termalismo, ainda esbarra, porém, na falta de profissionais especializados e na concentração de procedimentos nas regiões Sudeste e Sul.

De acordo com Carmem De Simoni, coordenadora do programa do ministério que reúne essas práticas, o desafio agora é formar profissionais no SUS que trabalhem para o SUS. "Mesmo que um gestor queira implantar homeopatia no Amazonas, ele não encontrará profissional no Sistema Único de Saúde", afirma De Simoni.

A prática da acupuntura também é motivo de discórdia entre os médicos e o ministério. Os médicos entendem que a prática é um ato que deve ser restrito a eles porque envolve um diagnóstico anterior.

Eles argumentam que uma dor lombar, por exemplo, pode ter causa muscular (que poderia ser amenizada com as agulhas), mas também pode ser sinal de algo mais sério, como um problema neurológico.

"Eu não posso simplesmente experimentar a acupuntura nessa pessoa. E se ela tem um tumor na coluna que está comprimindo o nervo? Ela precisa de um outro tipo de tratamento. O médico tem que avaliar a pessoa para saber que diagnóstico ela tem e ver quais as alternativas que existem nas diferentes especialidades", afirma José Luiz Gomes do Amaral, presidente da AMB (Associação Médica Brasileira).

Já o Ministério da Saúde aceita que outros profissionais da saúde, devidamente habilitados, apliquem acupuntura. Argumenta que os fisioterapeutas, por exemplo, reconhecem a acupuntura como prática da especialidade desde 1981, 15 anos antes dos médicos.

"Quem legisla no país a respeito do exercício das profissões são o Congresso Nacional e as categorias profissionais. O ministério tem poder executivo, não legisla. Nosso mote é agir com responsabilidade e segurança. A acupuntura está no programa de forma multiprofissional", diz De Simoni.

Evidência científica

Outro debate que existe no meio acadêmico é a falta de evidência científica de procedimentos que constam do programa do governo. De Simoni diz que o ministério tem apoiado grupos de estudo que buscam comprovar cientificamente a eficácia dessas práticas.

Em Campinas (SP), por exemplo, um estudo mostrou que houve diminuição do uso de anti-inflamatório depois da implantação do lian gong, uma prática corporal da medicina tradicional chinesa.

O lian gong e o tai chi chuan tiveram um aumento de 358% no SUS entre 2007 e 2008 (27.646 práticas, contra 126.652), segundo o Ministério.

Garimpeira relata violência sexual durante ataque no Suriname

A garimpeira Maria (nome fictício), uma das vítimas do ataque a brasileiros no Suriname na noite de Natal, afirma ter sido vítima de uma tentativa de estupro. Ontem, o governo do país confirmou dois casos de violência sexual ocorridos durante o incidente.

Em relato ao enviado especial da Folha ao Suriname, João Carlos Magalhães, Maria disse que teve suas roupas arrancadas e que foi apalpada por vários descendentes de quilombolas.

"Eles rasgaram a minha blusa e meteram a mão nos meus seios, a boca nos meus seios. Me beijavam na boca, e eu tinha que beijar na boca deles", disse.

Ela afirmou ter se salvado graças ao segurança do hotel onde estava, que disse que Maria era dominicana, e não brasileira. As agressões deixaram dezenas de feridos.

Segundo informações de testemunhas, quilombolas surinameses, chamados de 'marrons', atacaram cerca de 200 brasileiros e chineses que viviam na região de Albina, a 150 km de Paramaribo, muitos deles ligados ao garimpo ilegal.

O crime aconteceu depois de um brasileiro ter sido acusado de matar um surinamês. Pelo menos 25 pessoas ficaram feridas. Não há registro oficial de mortes, e o governo brasileiro pede cautela na definição sobre um número de desaparecidos.

Garimpeiro diz que corpos foram escondidos no Suriname

O garimpeiro Carlos Alberto Brito contou ao enviado especial da Folha ao Suriname, João Carlos Magalhães, como o brasileiro apelidado de "Peixe-Boi" matou um surinamês, o que teria desembocado no sangrento ataque na noite do Natal.

Segundo o garimpeiro, a ação já tinha data e horário marcados pelos "maroons" (como são chamados os descendentes de quilombolas no Suriname) muito antes da briga.

Brito diz ainda que os policiais não protegeram os brasileiros de agressões. Marcas de sangue estariam sendo apagadas por surinameses. Ele questiona ainda o paradeiro do corpo de um homem que ele diz ter visto ser assassinado e ainda não foi encontrado.

A Embaixada do Brasil no Suriname está acompanhando a situação dos brasileiros feridos no ataque e que foram transferidos para Paramaribo, capital daquele país.

Surinameses atacaram cerca de 200 garimpeiros brasileiros em Albina (150 km da capital) na noite de Natal. Pelo menos três brasileiros continuam internados em estado grave em um hospital de Paramaribo após o ataque, que deixou ao menos 25 feridos, segundo o Ministério de Relações Exteriores do Brasil.
